(a) Under Letters of Authorization issued pursuant to §§216.106 and 217.148 of this chapter, the Holder of the Letter of Authorization (hereinafter "BP") may incidentally, but not intentionally, take marine mammals within the area described in §217.140(b), provided the activity is in compliance with all terms, conditions, and requirements of the regulations in this subpart and the appropriate Letter of Authorization.

(a) Certain persons other than the permittee are authorized to carry on a permitted activity for the remainder of the term of a current permit, provided they comply with the provisions of paragraph (b) of this section. Such persons are the following:

To incidentally take marine mammals pursuant to the regulations in this subpart, the U.S. citizen (as defined by §216.106) conducting the activity identified in §218.80(c) (the U.S. Navy) must apply for and obtain either an initial LOA in accordance with §218.87 or a renewal under §218.88.

(a) As outlined in the AFTT Study Area Stranding Communication Plan, the Holder of the Authorization must notify NMFS immediately (or as soon as clearance procedures allow) if the specified activity identified in §218.80 is thought to have resulted in the mortality or injury of any marine mammals, or in any take of marine mammals not identified in §218.81.

Horned larks (Eremophila alpestris), house finches (Carpodacus mexicanus), and white-crowned sparrows(Zonotrichia leucophrys) may be taken in Fresno, Merced, Napa, and Sonoma Counties in California if they are depredating on agricultural or horticultural crops. Take of birds under this order must be done under the supervision of the county agriculture commissioner. You do not need a Federal permit for this depredation control as long as you meet the conditions below, but a depredation permit (see §21.41 in this subpart) is required for take of other migratory bird species, or for take of horned larks or white-crowned sparrows from May 1 through October 31.
